Terms and Conditions

Please read these Terms and Conditions carefully before using the ClickDent.eu platform, operated by ClickDent SRL, with headquarters in Bucharest, Romania. By accessing or using the platform, you confirm that you have read, understood and accepted these terms in their entirety.

1. Nature of the Service — What Is ClickDent

ClickDent (clickdent.eu) is a digital online promotion platform and dental clinic directory, aiming to facilitate dental tourism in Romania by connecting patients from Romania and Europe with verified dental clinics.

Explicitly and unequivocally:

• ClickDent does NOT provide medical, dental or healthcare services of any kind;
• ClickDent is NOT a medical facility and does NOT hold a medical authorisation under Law 95/2006 on healthcare reform;
• ClickDent does NOT employ doctors, dental technicians or other medical personnel;
• ClickDent does NOT guarantee the quality, safety or outcomes of treatments provided by partner clinics;
• The clinics and doctors listed on the platform are independent entities with their own medical authorisations, staff and exclusive medical responsibility;
• ClickDent acts exclusively as a marketing and promotion intermediary in the relationship between patients and clinics.

The platform's mission is to promote dental tourism in Romania and to bring as many European patients as possible into contact with quality dental clinics in our country.

2. Definitions

Within these Terms and Conditions, the following terms have the meanings set out below:

• "Platform" — the website accessible at ClickDent.eu, including all pages, functionalities and related services, operated by ClickDent SRL.
• "User" — any natural or legal person who accesses or uses the Platform, regardless of purpose.
• "Patient" — a User who completes a quote request form to obtain information or offers from dental clinics.
• "Partner Clinic" — any dental medical facility that has entered into a collaboration agreement with ClickDent SRL, is listed in the directory and receives leads through the Platform.
• "Lead" — a quote request completed by a User through a form on the Platform, containing contact data and details about the desired treatment.
• "Directory" — the list of verified clinics and doctors published on the Platform.
• "Content" — any text, image, graphic, logo, video, data or other information published on the Platform.

3. Platform Services

The ClickDent Platform exclusively offers commercial and marketing services, namely:

• Publishing a verified directory of dental clinics and dentists in Romania;
• Collecting quote requests (leads) from patients and forwarding them to relevant Partner Clinics;
• Publishing editorial content of a purely informational nature regarding dental treatments;
• Facilitating direct contact between patients and Partner Clinics;
• Promoting dental tourism in Romania.

Important: ClickDent acts exclusively as a marketing intermediary. The Platform does not provide, offer, plan or guarantee medical or dental services. All treatments are performed exclusively by Partner Clinics, which are fully responsible for the medical services rendered.

4. Platform Role and Clinic Verification

ClickDent requests the necessary documents from Partner Clinics to be listed in the directory, including operating authorisations, doctors' diplomas and malpractice insurance evidence. This documentary verification:

• Represents an administrative verification of the existence of documents, not a medical evaluation or quality accreditation;
• Does not constitute a medical guarantee of any kind;
• Does not guarantee the competence, quality or outcomes of the respective clinic's treatments;
• Does not transfer medical responsibility from the clinic to ClickDent.

Ratings and reviews displayed on the Platform represent Users' opinions, not ClickDent's. ClickDent does not verify or guarantee the authenticity or accuracy of reviews but reserves the right to remove content that violates platform policies.

ClickDent has the right to remove from the directory any clinic that no longer meets partnership conditions, no longer holds the required authorisations, or about which serious unresolved complaints exist.

5. Matching and Lead Generation Service

The process of obtaining quotes through the Platform proceeds as follows:

Step 1 — Completing the form

The User completes the request form available on the Platform, specifying the desired treatment type, estimated budget, country of origin and contact details (name, email, phone). By completing and submitting the form, the User explicitly consents to the transmission of their data to relevant Partner Clinics.

Step 2 — Processing and forwarding

ClickDent analyses the request and forwards it to one or more relevant Partner Clinics. The User receives an email confirmation. ClickDent does not guarantee a minimum number of quotes received and does not guarantee that any of the contacted clinics will respond.

Step 3 — Direct contact with the clinic

Partner Clinics contact the User directly with personalised offers. Any decision regarding the choice of clinic, scheduling or commencing treatment belongs exclusively to the User. ClickDent is not a party to the contract between the User and the Partner Clinic.

Financial transparency: The matching service is free for patients. There are no hidden commissions or fees for Users. The terms of collaboration between ClickDent and Partner Clinics are defined in the partnership contract concluded separately.

6. Medical Disclaimer

The content published on the Platform is of a purely informational and educational nature. ClickDent does not provide medical advice, diagnosis or personalised treatment recommendations.

The information presented on the Platform:

• Does not constitute medical advice and does not replace a consultation with a specialist doctor;
• Does not represent a specific treatment recommendation for the User's individual situation;
• May be approximate and does not necessarily reflect the latest medical developments or clinical protocols;
• Does not substitute for a diagnosis established by a doctor following a clinical consultation.

The User is responsible for consulting a specialist doctor before making any decision regarding a medical or dental treatment. ClickDent is not liable for any medical decision made by the User based on information published on the Platform.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ClickDent does not guarantee and cannot be held liable for:

• Quality of medical services provided by Partner Clinics;
• Outcomes of dental treatments performed by Partner Clinics;
• Medical complications arising from treatments, including post-treatment;
• Accuracy of information provided by Partner Clinics in their profiles or in quotes sent;
• Availability or competence of doctors and clinical staff listed on the Platform;
• Data loss, service interruptions or temporary unavailability of the Platform;
• Direct, indirect, incidental, special or consequential damages resulting from the use or inability to use the Platform;
• Actions or omissions of third parties, including Partner Clinics or technical service providers.

Liability cap: ClickDent's total liability to a User or Partner Clinic, regardless of the legal basis invoked, is limited to the maximum extent permitted by applicable law. The specific terms of liability between ClickDent and Partner Clinics are defined in the partnership contract concluded separately.

8. Feedback, Reviews and Quality

ClickDent encourages Users to provide genuine, honest and constructive feedback about their experience with Partner Clinics. Reviews and ratings contribute to:

• Increasing the quality of dental services in Romania;
• Correctly informing other patients looking for dental treatments;
• Supporting the development of dental tourism in Romania.

The User guarantees that published reviews reflect genuine, personal experiences and are not false, defamatory or motivated by commercial interests. ClickDent reserves the right to remove reviews that do not meet these criteria without prior notice.

9. User Obligations

By using the Platform, the User undertakes to:

• Provide correct, complete and up-to-date information in all Platform forms;
• Be at least 18 years of age or have the consent of a legal guardian;
• Not use the Platform for illegal, fraudulent or public-order-violating purposes;
• Not submit multiple or fictitious quote requests with the purpose of disrupting Partner Clinics' activity;
• Not interfere with the Platform's operation through the use of bots, scripts, scraping tools or any other unauthorised automated methods;
• Respect the intellectual property rights of ClickDent and third parties.

ClickDent reserves the right to block access for any User who violates these obligations, without prior notice.

10. Partner Clinic Obligations

Partner Clinics receiving leads through the Platform undertake, by signing a separate partnership contract, to:

• Hold all authorisations, licences and approvals required for legal operation as a medical facility in Romania;
• Contact the User within a reasonable timeframe and provide correct, clear and transparent offers;
• Respect the confidentiality of Users' personal data in accordance with the GDPR;
• Not use Users' data transmitted through the Platform for purposes other than providing the requested quote;
• Comply with applicable medical and ethical standards in providing dental services.

ClickDent is not liable for the actions or omissions of Partner Clinics towards Users. Any complaint regarding medical services received should be addressed directly to the Partner Clinic and, where applicable, to the College of Dentists of Romania or competent authorities.

11. Intellectual Property

All content available on the Platform — including text, articles, guides, graphics, logos, images, interfaces, source code and the Platform's structure — is the exclusive property of ClickDent SRL or its licensors and is protected by Romanian and international copyright and intellectual property legislation.

Partner Clinics retain rights to their own content (photographs, descriptions, own logos) and grant ClickDent a non-exclusive licence to use them for promotion on the Platform for the duration of the partnership.

Copying, reproducing, distributing or commercially using any Platform content without the prior written consent of ClickDent is prohibited.

12. Governing Law and Legal Framework

These Terms and Conditions are governed by and interpreted in accordance with Romanian law and applicable European regulations, including:

• Regulation (EU) 2016/679 (GDPR) — on the protection of personal data;
• Law 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector;
• Directive 2000/31/EC on information services and electronic commerce;
• GEO 34/2014 on consumers' rights in contracts concluded with professionals;
• Law 95/2006 on healthcare reform — confirming that ClickDent is not and cannot substitute for a medical facility;
• Romanian Civil Code on contractual and extra-contractual liability.

Any dispute arising from or in connection with the use of the Platform shall be resolved amicably in the first instance. In the absence of an amicable settlement, disputes shall be subject to the exclusive jurisdiction of the competent courts in Bucharest, Romania.

Users who are consumers within the meaning of European legislation also benefit from the protection of the mandatory rules of the EU Member State in which they reside. The European Commission's ODR platform is available at ec.europa.eu/consumers/odr.

13. Modification of Terms

ClickDent reserves the right to modify, update or revise these Terms and Conditions at any time. Changes will be published on the Platform indicating the date of last update.

In the case of substantial modifications, ClickDent will notify Users by email (if the address is available) or by displaying a prominent notice on the Platform at least 30 days before the new terms take effect.

Continued use of the Platform after the new terms take effect constitutes tacit acceptance of them.
